The European Court of Justice has made an initial ruling in favour of the UK government's wish to relax the cap on the UK's emissions under the European Emissions Trading Scheme. The European Commission had initially refused to consider the UK's proposed revision to its cap as they presented the proposal too late and they said it would destabilise the market. However the Court ruled that the Commission can not ignore revision proposals based solely on the date of submission. The judges pointed out that the Commission had not indicated how it would destabilise the market given it was only a 2.7% increase and it had not ruled on another 9 Member States' caps. |
